This version applies to our games made available as TikTok Minis within TikTok.
These Terms of Service ("Terms") form a binding agreement between you and Pixel Illustrations Technology Co., Limited, a company incorporated in Hong Kong ("we", "us", "our"), governing your access to and use of our games and related services (the "Services"). Development and technical support are provided by our affiliate Xiamen Pixel Party Network Technology Co., Ltd.
1. Acceptance of the Terms
By accessing or playing our games, you agree to these Terms and to our Privacy Policy for TikTok Minis, available at mostgametime.com/privacypixel.html, which is incorporated by reference. If you do not agree, do not use the Services. If you are using the Services on behalf of another person, you confirm you have authority to bind that person to these Terms.
2. Changes to the Terms
We may update these Terms from time to time, for example to reflect new features, legal requirements or changes to the Services. The "Last updated" date identifies the current version. Material changes will be posted on this page and, where appropriate, notified through the Services or the TikTok platform. Your continued use after changes take effect constitutes acceptance of the updated Terms.
3. Who May Play
You must meet (a) the age rating displayed for the game in your region and (b) the minimum age of 13, or the digital age of consent in your region if higher (which ranges from 13 to 16 across parts of the EEA and the UK). If you are below the age of majority where you live, a parent or legal guardian must consent to these Terms on your behalf and is responsible for your use. You may not use the Services where doing so would violate local law, and you are responsible for complying with the laws of the region from which you access the Services.
4. Your License to Play
Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and play the Services for your own non-commercial entertainment, through the TikTok platform and on devices supported by it. We may update, modify or discontinue any part of the Services at any time. You do not receive any ownership rights in the Services or in any game content, progress or items.
5. Advertising, Purchases and Virtual Items
Free, ad-supported games. The Services are provided free of charge and are funded by advertising delivered through the TikTok platform. Your use of the Services is conditional on the display of this advertising, which you may not block, interfere with or manipulate.
Virtual items. Where the Services include in-game currency, items or other virtual goods ("Virtual Items"), you receive a limited, non-transferable license to use them within the game. Virtual Items have no real-world cash value, are not redeemable for money or goods outside the game, cannot be sold, traded or transferred between users, and remain our property. Virtual Items may be consumed as you play and may be adjusted, changed or removed in updates.
Purchases and subscriptions. Any purchases or subscriptions made within a TikTok Mini are processed by TikTok or its payment processors under TikTok's own terms and pricing shown at checkout. We do not receive or store your payment card details. Refunds, cancellations and subscription management are handled by TikTok or the payment method provider in accordance with their refund policies and applicable mandatory consumer law; please contact TikTok support for purchase-related requests.
Statutory withdrawal right. Consumers in the EEA, the UK and certain other regions have a legal right to withdraw from digital-content contracts; that right is lost once performance has begun with your prior express consent and acknowledgement, as occurs when Virtual Items are delivered or consumed immediately.
6. Acceptable Use
When using the Services, you must not:
- Use cheats, exploits, automation software, bots, scripts, emulators, modified clients or unauthorized third-party software to play, farm rewards, generate impressions/clicks on advertising, or alter game results or progress;
- Exploit, disclose or trade any bug or vulnerability for advantage, or attempt to gain unauthorized access to the Services, our systems, other users' accounts or data;
- Reverse engineer, decompile, disassemble, copy, modify, create derivative works of, scrape or otherwise attempt to derive source code from the Services, except to the extent such restriction is prohibited by mandatory law;
- Resell, rent, lease, sublicense or commercially exploit access to the Services, or use the Services to provide a service to third parties;
- Remove or alter any copyright, trademark or other proprietary notices;
- Transmit viruses or harmful code, disrupt servers or networks, or interfere with others' enjoyment of the Services;
- Use the Services for any unlawful, fraudulent, abusive or discriminatory purpose, or to infringe anyone's rights.
We may investigate and take proportionate action — including removing access, progress or Virtual Items — for breaches of this section.
7. Our Intellectual Property
The Services, including their code, art, characters, designs, music, text, gameplay systems and trademarks, are owned by us or our licensors and protected by intellectual property laws. All rights not expressly granted to you are reserved. Feedback or suggestions you choose to send us may be used without obligation to you.
8. Platform and Third-Party Services
The Services run inside TikTok. Your access is also subject to TikTok's terms of service, community rules and payment terms, which apply between you and TikTok. TikTok independently provides hosting, advertising and payment functions and processes information under its own privacy policy; see tiktok.com/legal/privacy-policy. We also use analytics providers such as GameAnalytics, as described in our Privacy Policy. We are not responsible for the TikTok platform or other third-party services, their availability, content or practices. If a third-party service stops being available, features that depend on it may cease without entitlement to a refund.
9. Suspension and Termination
You may stop using the Services at any time. We may suspend or terminate your access, with or without notice, where we reasonably believe you have breached these Terms, where required by law or the platform, or to protect the security or integrity of the Services. On termination, your right to use the Services and any Virtual Items ends. Sections that by their nature should survive will continue to apply.
10. Disclaimers
The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, uninterrupted or error-free operation, or that defects will be corrected. We do not guarantee that the Services will always be available or compatible with your device or TikTok version. Nothing in these Terms removes or limits any guarantee, warranty, right or remedy you cannot contractually waive under the consumer or other mandatory laws of your country.
11. Limitation of Liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, progress, data, goodwill or business, arising out of or related to the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us (if any) in the twelve months before the claim arose and USD 100. Nothing in these Terms limits liability for fraud, willful misconduct, or death or personal injury caused by negligence, or any liability that cannot be limited under mandatory law (including mandatory consumer-protection law in the EEA, the UK and elsewhere).
12. Indemnity
Where permitted by law, you agree to indemnify and hold us harmless from claims, liabilities and reasonable costs arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right. This section does not apply to the extent such liability cannot be imposed on you under mandatory consumer law.
13. Governing Law and Disputes
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law rules, and the parties submit to the non-exclusive jurisdiction of the courts of Hong Kong. If you are a consumer residing in the EEA, the UK, Brazil, Türkiye or another region whose mandatory laws grant you the protection of its courts, nothing in this section deprives you of those protections or of the right to bring proceedings in your local courts.
14. General
- Entire agreement: these Terms and the Privacy Policy are the entire agreement between us regarding the Services.
- Severability: if any provision is held unenforceable, the rest remains in effect.
- No waiver: failure to enforce a right does not waive it.
- Assignment: we may assign these Terms in connection with a merger, acquisition or asset sale; you may not assign them without our consent.
- Language: where we have provided a non-English translation, the English text prevails except where mandatory law provides otherwise.
